   1. The version of the following General Terms and Conditions valid at the time of the order applies. No verbal additional agreements have been made. The General Terms and Conditions can be stored on your computer and/or printed out for the purposes of placing online orders.
      
   2. The online photovoltaic shop is a business operation of Antaris Solar GmbH & Co. KG, Am Heerbach 5, D-63857 Waldaschaff. Tel. +49 7564 9482200.
2. Conclusion of contract / Quantities
   1. The customer friendly photovoltaic shop enables you to place orders via internet 24 hours a day, including at weekends. The presentation of the products in the online shop constitutes a non-binding online catalogue and not a legally binding offer. You place a binding order for the articles in your shopping basket by entering your personal data and then clicking the "Order" button. After completing the order process you will receive immediate confirmation that it has been received. A contract of sale is concluded upon receipt of our acknowledgement of order or delivery of the goods. Prices have been quoted correctly to the best of our knowledge. If the photovoltaic shop website nonetheless contains obvious mistakes, such as spelling, typing or calculation mistakes, we retain the right to charge the correct price. In such cases we grant you the right to withdraw from the contract immediately if you do not accept the corrected price.
      
   2. Purchase orders are subject to availability of the correct goods in good time provided that the unavailability of goods is due to non deliveries for which Fotovoltaikshop is not responsible. We shall inform and reimburse any consideration already provided immediately if the goods are not available. We reserve the right to deliver only standard household quantities of goods to end customers and resellers.
3. Cancellation rights
   
   1. You are entitled to revoke your contractual declaration in text form (e.g. letter, fax, email) within a period of two weeks without stating grounds or by returning the goods, unless you have placed an order as part of your commercial or self-employed activities (orders placed by business enterprises). The time period begins with the receipt of the goods at the earliest accompanied by detailed written information about your cancellation rights. This period will be deemed as having been observed if notification is sent or the delivered goods are returned within this period. Notification of cancellation must be sent to:

   2. Consequences of cancellation: If the contract is successfully rescinded, the delivered goods and any payments received will be returned to the relevant party to the contract and any benefits associated with the same (such as interest) surrendered. In the event that you are not able to return all or part of the goods delivered to you, or if you return the delivered goods in a damaged condition, you will be obliged to pay a certain amount of compensation. This will not apply if the damage to the goods is solely the result of the performance of inspections of the type which may be carried out in retail business. Furthermore, you can also avoid the payment of compensation for damages if you do not make use of the goods as owner and do not do anything to otherwise affect the value of the goods. Goods that can be sent by parcel post can be returned to us at our own cost and risk; goods that cannot be sent by parcel post will be collected from you.

4. Delivery / Disposal
   
   1. Unless otherwise agreed with you, goods are delivered ex warehouse to the stated delivery address. Please refer to our website for projected delivery periods. If no information is provided on the website, deliveries are made within 7-14 days of acceptance of the order.
      
   2. The risk to the ordered goods passes to the customer upon delivery of the goods, including in the case of partial deliveries. If the purchaser refuses acceptance of the goods, Antaris Solar GmbH & Co. KG shall be entitled, upon abortive expiry of a reasonable period of two weeks, to withdraw from the contract or to demand compensation. Without prejudice to the purchaser's guarantee rights, the delivered goods shall be accepted by the purchaser, including in cases of insubstantial defects.
5. Payment
   Payment for the goods shall be made in advance to the account held by Antaris Solar GmbH & Co. KG with Volksbank Biberach. The customer shall receive a money-back guarantee from Trusted Shops GmbH in collaboration with the insurance company Atradius Versicherung (www.trustedshops.de).
6. Minimum purchase order
   The minimum purchase order value is 50 euros incl. VAT. The minimum purchase order value does not apply to computer applications. Delivery of minimum purchase orders is free within Germany.
7. Warranty / Complaints
   The statutory guarantee provisions shall apply, subject to the following specific terms:
   1. Defects shall be notified to us by non-consumer purchasers immediately following detection of such defects within the guarantee period of one year.
   2. In the case of legitimate complaints, the purchaser shall be entitled, in accordance with statutory guarantee provisions and in the cases foreseen by law, in particular in the event of abortive supplementary performance, to withdraw from the contract or to demand a reduction in price. If the purchaser withdraws from the contract, the purchaser shall return the goods in full at the cost of Antaris Solar GmbH & Co. KG.

   4. Product characteristics are only guaranteed by Antaris Solar GmbH & Co. KG where an explicit guarantee has been issued. The liability of Antaris Solar GmbH & Co. KG is limited to damages to the goods themselves. The purchaser shall, in particular, only be entitled to assert claims for compensation based on any consequential damages in the absence of an explicitly guaranteed characteristic or if a guarantee has been given excluding the risk of the relevant consequential damages occurring. Further claims asserted by the purchaser – regardless of their legal standing – are excluded.
   5. The above disclaimer (8d) shall not apply to cases of gross negligence, wilful intent, or injuries to life and health. Neither shall the disclaimer apply to claims covered by the German Product Liability Act (Produkthaftungsgesetz), to instances of delay, cases of impossibility for which Antaris Solar GmbH & Co. KG is responsible, or to defects of title. The disclaimer shall not apply should Antaris Solar GmbH & Co. KG culpably commit a breach of contract. In the event of a breach of contract, liability shall be limited – except in the case of wilful intent, gross negligence or warranted characteristics – to reasonably foreseeable damages.
8. Applicable law / Legal venue
   All differences of opinion and legal disputes arising in connection with this business relationship shall be subject exclusively to German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Should an action be brought and should the purchaser's principle domicile or regular address not be in Germany, or should such domicile or address not be known to Antaris Solar GmbH & Co. KG, and/or if the purchaser is a businessperson, the legal venue shall be agreed to be Leutkirch, Allgäu.
9. Severability
   Should one or several of the provisions of these General Terms and Conditions and/or of contracts supplemented by these General Terms and Conditions be or become null and void, this shall not affect the validity of the remaining provisions of the contract and these General Terms and Conditions shall remain effective for both parties.
